Terms & Conditions
The following is a sample terms & conditions for ESB photography.
Copyright & Usage Rights:
All Images remain the copyright of ESB Photography for 70 years under UK law, and may not be reproduced, edited or sold without written permission.
Clients receive a personal use license, for downloading, sharing and printing images.
For social media use, photographer credit must be included (e.g.: @esb_.photography.
Images must not be altered, filtered or re-edited without prior written consent.
ESB Photography may request the use of images for portfolio, website, social media, or promotional purposes. Images will not be shared publicly without prior confirmation from the client, unless otherwise agreed in writing.
Clients acknowledge that ESB Photography will deliver a carefully curated selection of the best images at her professional discretion. Unedited or rejected files, including RAW images, will not be provided.
Clients are responsible for ensuring they have permission from any individuals featured in the images. For group shoots or events, the client must notify ESB Photography of any person who does not wish to be photographed.
For sessions involving minors, a responsible adult must be present and provide consent for their participation.
*Commercial or business use of images requires a separate license agreement and may incur additional fees. Clients may not reproduce, distribute, or use images for commercial purposes without explicit written permission.
Editing & Creative Control:
All images are delivered in the artistic style of the photographer. No additional edits or raw files will be provided to the client, unless otherwise agreed on.
Client agrees to trust the photographers vision and process
Additional edits or retouching may be requested for commercial projects and will be subject to separate agreement and fees.
Delivery of Gallery & Storage:
Final photos are delivered via an online gallery within 14 days of the session, unless otherwise agreed.
Standard online galleries are stored for up to 3 months following delivery. Clients are strongly advised to download and securely back up all images.
ESB Photography does not guarantee long-term archiving of files. Extended storage can be arranged for commercial or editorial projects at additional cost.
Delivery times are estimates and may be extended during peak periods or due to unforeseen circumstances.
Payment & Cancellation:
A 30% non-refundable deposit is required to confirm the booking.
Cancellations made within 72 hours of the session forfeit their deposit.
Reschedules may be allowed if requested before the 72-hour cancellation period, subject to availability.
Late arrival may result in reduced shooting time; sessions will end at the scheduled time.
If the photographer is unable to attend due to illness or an emergency, the session will be rescheduled at the earliest available date. If no suitable date can be arranged, the client will receive a full refund of any payments made.
travel & Location:
Travel within London is included in the shoot cost. Travel outside of London may incur extra charges (*from £0.45 per mile) which will be agreed upon prior to the session.
Sessions may be postponed due to severe weather conditions at the photographer’s discretion. The session will be rescheduled at the earliest available date. If no suitable date can be arranged.
Conduct & Safety:
The photographer reserves the right to terminate a session without refund if faced with unsafe, abusive, or disrespectful behaviour.
The client agrees to communicate clearly, treat the photographer with respect, and contribute to building a safe environment.
In this light, the photographer is not liable for delays due to weather, strikes, or similar unforeseeable circumstances.
ESB Photography is not liable for indirect or incidental damages arising from the services provided. Liability is limited to the total fees paid by the client.
Client Information:
Client details are stored securely and used solely for communication, booking, and delivery of services.
Clients may request access, correction, or deletion of their personal data in line with UK GDPR regulations.
No client information is shared with third parties except where legally required or necessary for the delivery of services.
